I know this isn't specifically W.PA/E. Ohio, but this seems like the best place for this. I'm not sure if anyone saw, but Tony Stewart settled with the Wards. I really think it is a shame. IMO they should be paying him, (and the rest of the racing community), millions, but I realize that they're a bunch of inbreds who will be never have a dime for the rest of their lives, even after the big payday. The sadistic side of me would love to see a story on them 5 years from now after they blew threw the whole settlement and are deeper in debt for it.

My dad drove late models in the early 70's at North Hills, Butler, Mercer, Blanket Hill, and occasionally Tri City. We won the last late model track championship at Blanket Hill.

This is not the first lawsuit of this type. In 1903 when the only 2 know cars in the state of Ohio got together. A lawsuit ensued and the basic law of the land was made " The driver, or operator, of a motor vehicle, horseless carriage, must maintain control of said at all times."

I was following this close due to the impact on promoters due to insurance issues. Essentially my concern was the waiver as the Ward family was essentially questioning the legality of the waiver. As soon as that judge stated that the family could sue and that the waiver was invalid i was concerned for racing in general. I would have liked to see this play out to see what role it would play. Now we wont know till the next sole or promoter is blind sided. the waiver has to mean something. the ward family found the one judge who felt not
The problem is, and this extends further than this case, that judges consider themselves to be gods over the law, rather than just administrators of the law. That means that there really is no law, because any judge anywhere can just pee all over it, and then it sets "precedence" for all of the other judges to do the same. So now we have the idiot Darwin Award winner, and his equally idiot family successfully making others responsible for not one of them having the smallest sliver of sense or intellect and setting a precedence that makes all liability agreements at any track suspect.
