Marion Center Speedway--July 29th Cancelled

Received a phone call from one of the vendors that the opening of Marion Center Speedway tomorrow July 29th is NOT HAPPENING.

Maybe since you're taking the word of a vendor and not the track promoter or an official, you should have put a question mark after cancelled in your subject line so people don't think this is real or official.

 

It may be true, but you may also have received second, third hand information that is speculative and not really true.

 

But it is 2018, so it's more important to be first than to be right.  Perhaps you should apply at Fox News or CNN.

Not a word on their Facebook page about cancelling and the new promoter/team has been very good about getting info on there quickly.

You are right, I should have put a question mark since I don't represent the track or the gentleman promoting tomorrow's program.  My apologies.

 

Not trying to be first--just letting people know.  Vendor"s info came from a reliable source.  I did check the website and facebook and saw nothing posted yet either.

Big E was promoting it last night at the track and the Stivasons were there, so I'd think if it was cancelled the Stivasons would know about it.  Hoping they can find a way to get the show in!

"Merle has been working endlessly to prepare the track and grounds for opening race night and simply has run out of time to make the needed updates. He is reluctant, but must postpone the races until next sunday so everyone can have the safest and best race experience possible. Although we are sure you are disappointed ( as are we) we hope you understand. We hope to see you all next weekend for the opening race night. Thank you in advance for your understanding."

"Marion Center Speedway is sorry this post is late. This is due to my sister having a medical emergency Monday night. The reason the track didn't open Sunday, July 29, was due to the fact Merle Black had no racing insurance, and then asked the Potts family to cover him. We are sorry that Merle Black pulled out due to the fact we did not sign his lease agreement, which contained his terms, NOT ours. MCS is already in discussion with other parties to help the Potts Family open the track. Keep watch here on Facebook and Website for more info when it becomes available."

 

If you are leasing, you are not the owner. Not providing racing insurance was Black's own fault. Some of you on here, are worse than FAKE news!

Sounds like they couldnt get insurance because the owners never signed any kind of leasing agreement. Seems like both sides are to blame.

More concisely: We did not sign his lease agreement, knowing that he wouldn't be able to obtain insurance without it, but allowed him to improve our property regardless.



If at first you don't succeed, then maybe you just suck.

WOW. Some people just don't seem to get it. The Potts own the land and the speedway. They do not need to cover someone's insurance costs, nor should they sign a lease presented by a potential client. Why someone would think otherwise is mystifying.

Nice..... Let the guy clean the place up, get some stuff painted, mow the grass get the track back in shape... all in preparation for a lease that you were never gonna sign...Nicely played....Sounds like Mr Black got schooled. Lesson learned???? Have a signed lease in your hand before you put your time and money into someone elses property.... :D

A lease agreement should not be done in haste as each side needs to protect their individual interests (and that is a very large umbrella term for a variety of factors). That said, negotiations, with or without counsel present, as well as the final product needs to be reviewed be each parties attorney before signing. In the end, if one side of the other has a decided advantage over the other then there will be trouble in paradise quickly. Also as a lessee any permanent capital improvements (with valid invoices or receipts) to the property, unless otherwise expressly agreed to, is eligible to be deducted from the lease amount (weekly/monthly). Before you say that you do not need to get attorneys involved you would be dead wrong. Both sides need the protection of a strong agreement with recitals that clearly state their obligations to one another. It is a contract. In today's world it is imperative and the only way to conduct business.

“In today’s world” a handshake deal is rare ,however Emails and texts are proof of an agreement !
There are two sides and both must benefit in any deal ( unless your the Clintons and selling America)
But if the guy started all that work assuming he would get his terms .. ya .. he got schooled
Too bad but it’s hard to imagine a business owner like was stated he was would make that mistake
And the track family sounds to have already thrown him under the bus and leasing all his hard work
for Sure we don’t know the whole story yet .. does anybody know the Magistrate of Marion center ? Probably would be a good source for the rest of this story

Ps
When you lease rental property
The property owner holds the property insurance and the renter buys a renters insurance for his personal property and it’s dirt cheep but it does not cover the structure of the house .. but who knows how it is structured for a race track
But you don’t need racing insurance if you don’t have a track to hold races at ,!
