Keep writing rubber checks and watch the car count decline. There is no excuse to not pay in cash at the end of the night.

Could care less whose feelings it hurts. He's got 7 days to rectify the problem then it's going to the Magistrate. Hopefully anyone else that this happened to does the same thing.

I would not even give him 7 days since it seems to be the norm at the place. Nothing like a good old surprise!

Oh we called and was told by him that there was plenty of money in the account to cover the check (keep in mind that the bank tried running it thru 4 times previously) so right after that phone call the bank was called and asked if there was sufficient funds to cover and they said no. It's not bashing when it's the truth.

I don't necessarily qualify this as bashing. It is a warning to other racers about getting paid from this place. Racing is expensive enough as is and then the drivers not getting paid is a recipe for a decrease is car counts. Money came in that night. Money should go out that night. Do the racers/pit crew/fans mail in checks for their entry fees.

And your right, why go back? I'm not. There are so many other issues with this track with terrible officiating, favoritism, and god forbid you say anything negative on social media.

Its funny though that this same issue keeps cropping up.

The same issue keeps coming up yet the gates are open every Friday and racers and fans, which they could care less if guys are getting paid, keep going back. In today's world I can't see a bank running a check thru over and over without contacting someone in a illegal issue. People go to jail for writing bad checks, and yet some on here say it happens on a regular basis. I smell fish. If your getting a bad check and have proof that others have the police would have to arrest the guy. Yet this has not happened. Hummm, carp or catfish, they both stink.

In the case of a bounced check, it can be a civil or criminal offence pending on the amount of the check. And yes you have to file a complaint with the magistrate. It all has to go through a legal process. Everyone who receives a check that has bounced should contact a magistrate. I hope this hopes.

I think this post is a great idea.  I wouldn't call it track bashing.  Just one guy making a public announcement.  This also lets other people who might be affected know they're not the only one and to not believe any lie that the track owner might try to give you.  We dealt with the same BS at AMP.  There are still some teams that haven't received all of their money.  Myself included.  You have to hold the track owners accountable.  I also agree that if you're not getting paid, then why would you go back the following week?  Lots of other tracks out there that Pay cash nightly.  Thunder Mountain, and Hummingbird both do.

you should contact the local police, some have an officer that handles bad check cases, HE then files charges at the magistrate CRIMINALLY . if the writer is found guilty , HE MUST PAY...

if you go civilly against him at the magistrate (without the force of law ) against him..all you end up with is a civil judgement against him..which CAN be hard to collect.. as pa law is very weak on collecting civil judgements..

you may want to start by sending him a (registered ) 10 day demand letter to pay up.. its the first step in the process ..  phone calls don't count...

best of luck collecting

Most bad check criminal cases, unless they are for a large amount of money are not filed by the police, but rather by a private criminal complaint at the local Magistrate's office.  In Allegheny County, the Asst. DA must approve the complaint and then the complainant can file it himself.  No fee for a private criminal complaint, however there is a fee for a civil complaint.  You must write a letter to the person who owes you money and then you have to wait 10 days before you can file a complaint.  A bad check worth under $200 is a summary offense, which means the magistrate has the power to find one guilty or not guilty.  Even if the amount of the check makes it a misdemeanor which could go on for further action in the Common Pleas Court, usually the person who got the bad check just wants to be paid, so even those cases are often settled at the Magistrate's for restitution and/or a fine.

You are right about this subject not being track bashing . But it was meant for all the other threads that the three Amigos continually do .

The debt has been paid in full including all bank fees with cash. There is no reason cash can't be paid out at the end of the night. Hopefully he starts doing that because that's the only way we would go back.
