I still have sympathy for his family, but I really feel that they should drop it now and move on...but I still think they will sue Tony, the track, ESS and everyone else that they can think of...I don't believe that they will do well now, because if you are under the influence you are automatically in the wrong.

Worked in drug and alcohol - take the whole "he was impaired" with a grain of salt for a couple reasons. First off most tests measure amount in blood system which has virtually nothing to do with impairment at the time of the incident. The day before or eight hours before wii register high even though there may be no signs of impairment. Smoking pot foes not make this a 'case closed' deal- regardless of where u stand.
So same goes for drinking? I may have had a few drinks and show no signs of impairment but according to the amounts in my system I am impaired. Does that make it acceptable to drink and drive/race? Absolutely not. This case IS damn near closed and if the Ward family wants to try a civil suit they can but I guarantee you that with all the evidence is in favor of Tony so they will be lucky to build a case against him. Especially, being IMPAIRED.

If the kid toked up the night before they'd get the same toxicology report......to say he burned one just before he strapped up is a stretch, I think......what killed the kid was several bad decisions...one right after the other and the worst one being "no self control" of his temper......

Come on people, use your heads, for anyone that has been around stoned folks, (not drunk AND stoned, just stoned), can anyone honestly recall a time where those stoned individuals got belligerent and violent?
That shit might give you the munchies, alter your way of thinking and make you stare at a spot on the wall for half an hour but I have never seen it make someone violent or increase their temper.
Really, it does quite the opposite. Do I think it was in his system from the day prior? Yep. Do I judge the kids character from the toxicology reports? No.
The kid made a bad decision on the track in the heat of the moment that cost him his life, I don't think Mary Jane had any influence on that decision at that time no matter what the toxicology report says. He's just one of many hot headed kids that unfortunately paid for a poor choice with his life.

Nope. They will file . Tony will settle out of court just to make this all go away. Cuz at the end of the day paying the family a million dollars to be happy and never deal with it again is cheaper easier and better than paying 4 million to lawyers to drag it out for 5 years and constantly have your name dragged through the mud fighting it. Just the way the system works.

Being impaired means that your blood levels are above those allowed by the law, whether it be alcohol or marijuana. I know nothing about New York's criminal statues, but in Pennsylvania, the code provides that you may not drive with any marijuana in your system, be it metabolytes or active THC, however, if the concentration is less than 5 nanograms per millimeter you probably won't be prosecuted, at least in Allegheny County. I may have missed it, but I haven't seen any numbers related to young Mr. Ward's level of impairment. I agree with the folks that maintain his behavior was caused by anger issues, not drug impairment. Metabolytes will stay in ones system for a long time, but is no indication of impairment.
